Terms of Use
Effective date: August 21, 2026
Introduction
Welcome to LitPDF Apps. LitPDF Apps ("us", "we", or "our") operates LitGiftCart (the "Service" or "app"), a Shopify application that helps merchants automatically add and remove free gift products in the cart based on promotion rules they configure.
By installing, accessing, or using our app, you acknowledge and agree to these Terms of Use. If you do not agree, do not install or use the Service. These Terms, together with our Privacy Policy, constitute your agreement with us.
The Service runs on the Shopify platform. Your use of Shopify is also governed by Shopify's terms and policies. Billing for paid plans is processed through Shopify Billing.
1. Pricing and Subscription Structure
LitGiftCart may offer free and paid plans (for example, Free and Pro) with different feature limits. Plan details and prices shown in the app, on our website, or in the Shopify App Store may change over time.
Any additional services — including but not limited to custom feature development, priority support retainers, integration work, or major revisions beyond the standard product — will be subject to the pricing structure in effect at the time of the request, regardless of the customer's original subscription date or plan.
Paid subscriptions renew according to Shopify's billing cycle unless you cancel or uninstall before renewal. Uninstalling the app or cancelling through Shopify stops future charges according to Shopify's billing rules; it does not automatically entitle you to a refund for the current period.
2. Custom Feature Requests and Revisions
We strive to accommodate customer requests while ensuring a fair balance between included product features and additional costs. Custom work (when offered) falls under the following categories:
Included / minor support
- Help configuring promotions, triggers, gifts, schedules, and theme embed enablement using existing product features
- Clarifying how Free vs Pro features work
- Bug reports for documented product behavior that is not working as intended
Major revisions (require an additional purchase)
- Any changes that require coding or developer involvement beyond standard support
- Custom storefront UI, theme code, or checkout modifications not included in the app
- New promotion rule types, integrations, or workflows outside the current product
- Structural or one-off customizations for a single merchant's theme or stack
Custom changes take time, testing, and effort. All revisions are thoughtfully scoped and priced to maintain quality and sustainability. We may decline custom work that we cannot support long-term.
3. Merchant Responsibilities
You are solely responsible for:
- Configuring promotions, selecting gift products, quantities, and schedules correctly before and after going live
- Monitoring inventory so free gifts do not oversell or create unexpected order outcomes
- Ensuring your theme, other apps, and checkout setup are compatible with LitGiftCart
- Complying with advertising, consumer-protection, tax, and other laws applicable to your promotions and storefront
- Providing accurate information to Shoppers about free-gift offers
We do not guarantee that gifts will always be added, removed, or discounted correctly in every theme, browser, or cart configuration, or that promotions will increase sales, conversions, or revenue.
4. Respectful Conduct and Service Termination
We value respectful and professional interactions. Any form of disrespectful, abusive, or inappropriate behavior toward our team will not be tolerated. We reserve the right to terminate any subscription or service without refund if a customer engages in such conduct.
We may also suspend or terminate access if you misuse the Service, violate these Terms, or use the Service in a way that harms us, Shopify, Shoppers, or other merchants.
5. Refund Policy
Because LitGiftCart is a digital Software-as-a-Service product delivered immediately upon install, and because paid plans are billed through Shopify, we generally do not offer refunds once a paid subscription period has started or once custom development work has begun.
However, if you are not satisfied with a new paid purchase, you may request a refund within 7 calendar days (including weekends) from the date of that purchase. Refunds are issued at our discretion and only if significant custom work has not already been completed. Refund processing may also depend on Shopify Billing rules and timelines.
Repeated or excessive requests that require developer time may exceed the scope of your plan and will not qualify for a refund. In such cases, we may suggest additional purchase options to continue the work.
6. Policy Updates
We reserve the right to modify these Terms at any time. We will post the updated Terms on this page and update the effective date. Customers may be notified of significant changes via email and/or a notice in the Service. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
7. Warranty and Disclaimer
Our services, software, documentation, and related content are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or meet your specific requirements.
Without limiting the foregoing, we do not warrant that: (a) gift products will always be added, removed, or discounted correctly; (b) promotions will produce any particular business result; (c) inventory, pricing, tax, or shipping outcomes on your store will be accurate; or (d) defects will be corrected.
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by applicable law, LitPDF Apps, LitGiftCart, and their owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, goodwill, business opportunity, or other intangible losses, arising from or relating to your use of (or inability to use) the Service — including without limitation incorrect free gifts, failed discounts, overselling, theme or app conflicts, Shopify platform changes, or third-party outages — even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless LitPDF Apps and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your promotions, gift offers, or storefront practices; (c) your violation of these Terms; or (d) your violation of any law or third- party right.
10. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law principles. Any disputes arising out of these Terms shall be resolved in the appropriate courts located in Florida, USA.
